Il Tar di Palermo ha infatti dichiarato illegittima l'esclusione del Comune dalla procedura di finanziamento indetta dalla Regione per la realizzazione di queste strutture. Il bando in questione è quello del Piano Operativo FESR Sicilia 2014-2020 per la concessione di agevolazioni in favore di Comuni, anche regolarmente associati in Ambiti di Raccolta Ottimali, per la realizzazione o ampliamento, potenziamento e adeguamento di centri comunali di raccolta. Il comune di Lucca Sicula aveva presentato un progetto con la richiesta di un finanziamento pari a circa 417 mila euro ma, al momento della pubblicazione della graduatoria finale nel giugno 2020, aveva appreso di essere stato escluso sul presupposto che il soggetto incaricato a verificare il progetto, si trovasse in una posizione di incompatibilità poiché aveva assunto anche il ruolo di progettista. A questo punto, il comune ha conferito incarico all’avvocato Girolamo Rubino per impugnare innanzi al TAR di Palermo l’esclusione dell’ente dalla graduatoria e scongiurare la perdita del finanziamento richiesto. In particolare, il legale, a sostegno della illegittimità dell’esclusione dell’ente dalla procedura di finanziamento, ha sollevato tra le motivazioni del ricorso la violazione del soccorso istruttorio mediante il quale l’amministrazione avrebbe dovuto consentire la regolarizzazione degli atti, non comportando alcuna modifica oggettiva del progetto presentato. Il Tar di Palermo, con ordinanza cautelare, in accoglimento delle tesi dell’avvocato Rubino, ha disposto il riesame del provvedimento di esclusione riconoscendo la possibilità di regolarizzazione della documentazione progettuale già presentata. Per effetto di tale pronunciamento, la domanda di finanziamento presentata dal comune di Lucca Sicula dovrà essere riesaminata, consentendo di regolarizzare la documentazione trasmessa in precedenza, nel termine di 30 giorni.
