La sentenza è stata pronunciata dai giudici della prima sezione della Corte d'Appello di Palermo ed è relativa all'unica condanna che l'ex presidente della Provincia di Agrigento si era vista infliggere in primo grado per abuso d'ufficio. Non avrebbe adeguatamente documentato, secondo i giudici del Tribunale di Agrigento, il fine istituzionale di alcune spese, relative soprattutto a pranzi e cene che pure erano state rimborsate dall'ente.
In realtà il processo a D'Orsi era relativo ad una trentina di capi d'accusa, dalla concussione alla corruzione, all'abuso d'ufficio. Tra le vicende che avevano destato particolare clamore mediatico, i lavori realizzati nella sua villa da parte di una delle ditte inserite nell'elenco delle imprese fiduciarie dell'ente, la vicenda delle palme messe a dimora da uno dei dipendenti della provincia, ma anche le famose penne regalate e acquistate con fondi pubblici, per finire alla questione dei rimborsi dei pasti. Già in primo grado erano cadute la maggior parte delle accuse, con l'assoluzione da parte dei giudici del Tribunale agrigentino, ad eccezione della condanna ad un anno per abuso d'ufficio.
La Corte d'Appello ha assolto D'Orsi anche per questa vicenda e analoga sentenza di assoluzione è stata emessa nei confronti del dirigente dell'ente Ignazio Gennaro.
Il tempo ci ha dato ragione, hanno dichiarato i legali di D'Orsi, restituendogli onorabilità e dignità a fronte dei lunghi processi affrontati in questi sei anni. Eugenio D'Orsi è stato l'ultimo presidente della Provincia di Agrigento. Dopo di lui è arrivata l'abolizione di questi enti, in realtà solo sulla carta. Sono saltati gli organi eletti dai cittadini, ossia presidente e consiglio provinciale, sostituiti da commissari che si sono succeduti in questi anni vari in attesa di portare a conclusione una riforma di cui tanto si era vantato l'allora governatore della Sicilia Rosario Crocetta, prima regione ad avere abolito l'ente intermedio tra comune e regione, salvo poi constatare che in realtà ben poco è cambiato.
