nei confronti della società che gestisce gli impianti in 27 comuni della provincia di Agrigento firmata nei giorni scorsi dal prefetto Dario Caputo. A confermarlo lo stesso presidente della società Marco Campione, che pur non volendo commentare il provvedimento nel merito ha dichiarato: "Ho passato la vita contro il pizzo e la mafia con i fatti, denunce e testimonianze in tribunale, faccia a faccia con gli estortori".
Intanto la Commissione regionale Antimafia si riunirà presso la prefettura di Agrigento il prossimo 13 di dicembre. Lo ha deciso Claudio Fava, a giudizio del quale l'interdittiva nei confronti di Girgenti Acque impone una attenta e urgente analisi della situazione da parte dell'organismo parlamentare da lui presieduto “perché – osserva Fava – l'acqua e la gestione delle risorse idriche rappresentano temi vitali per la nostra regione”. Una missione, quella ad Agrigento della Commissione, che sarà preceduta dall'audizione di martedì 11 dicembre di una delegazione del Forum per l'acqua e i beni comuni.
Forum Acqua e Beni Comuni che chiede che sia fatta piena luce sulle privatizzazioni dell'acqua e su tutte quelle che definisce “storture di carattere giudiziario, politico ed amministrativo ad essere legate”. Dopo l'interdittiva il Forum ritiene che non sia più rinviabile l'istituzione di una Commissione d'inchiesta in seno alla stessa Commissione Antimafia, per far luce sulle tante vicende che in 12 anni sono state ignorate dai governi regionali, compreso Musumeci che non ha ancora riscontrato l'ennesima istanza presentata all'attuale esecutivo in data 22 marzo.
Questione che, giocoforza, vede anche l'intervento politico. I parlamentari regionali pentastellati Mangiacavallo e Di Caro hanno chiesto all'ATI di non perdere tempo e di procedere alla definizione dell'iter di risoluzione del contratto o all'immediata revoca della concessione, alla luce di quanto previsto dall'articolo 94 del codice antimafia. “Da anni – dicono i due deputati agrigentini del Movimento 5 Stelle – chiediamo la risoluzione del contratto per le reiterate e gravi inadempienze di Girgenti Acque, ma la politica ha sempre fatto orecchie da mercante e non ha mai prodotto un atto concreto, ma ora non ci sono più scuse”.
E mentre è scontato che Girgenti Acque presenterà ricorso al TAR contro l'interdittiva antimafia, che ha ribaltato le liberatorie degli anni precedenti, Francesca Valenti, presidente dell'Assemblea Territoriale Idrica ha convocato per venerdì i sindaci dell'ATI per esaminare la questione, che stravolge se possibile la procedura tuttora in corso nell'ambito del tentativo di risoluzione del contratto tra l'ATI e il gestore privato delle risorse idriche pubbliche. Stamattina Francesca Valenti ha incontrato nuovamente l'avvocato Giuseppe Mazzarella, incaricato com'è noto di promuovere l'azione legale in rappresentanza dei sindaci. Un'azione legale contro la quale Girgenti Acque S.p.A., di fatto, pare intenda resistere sulla base di diverse controdeduzioni, partendo da quella specifica che contesta il presunto inadempimento originario dell'autorità d'ambito rispetto ad una consegna parziale degli impianti idrici, considerato che la società gestisce gli impianti di 27 comuni sui 43 della provincia.
Una vicenda che Marco Campione, presidente di Girgenti Acque, da noi contattato, preferisce non commentare.
Si sa che le imprese destinatarie di interdittiva non possono avere rapporti con la pubblica amministrazione. In assenza di quella che viene definita "liberatoria antimafia", infatti, non solo non possono partecipare alle gare d'appalto, ma nei casi di appalti in corso, come quello tra la Girgenti Acque S.p.A. e l'ATI di Agrigento, il contratto perde ogni effetto. In questo quadro, e nelle more che vengano espletate le procedure di revoca della concessione, la società potrebbe essere gestita provvisoriamente da un commissario prefettizio. Sembra scontato nel frattempo il ricorso di Girgenti Acque al TAR contro il provvedimento in questione.
